Attempt to obtain but never did

Can a person get in trouble for trying

to obtaining a controlled substance?

as in they were about to realized

that it was a set up and left without

ever picking it up? is there a law

attempting to fill without actually

physically posessing the narcotic?

Also is the deposition of a few

employees enough to make a case

especially if most could not properly

identify the suspect?

Wow that's a lot of questions... Lets answer them in order:

1. Q:Can a person get in trouble for trying to obtaining a controlled substance?

A: Yes, it is called attempted possession of a narcotic. It lowers the class of the felony by 1 level.

2. Q: (what if they)were about (to get some but) realized that it was a set up and left without ever picking it up?

A: they would be in less trouble but still could face an attempt charge.

3. Q: is there a law attempting to fill without actually physically posessing the narcotic?

A: Yes.

4. Q: Also is the deposition of a few employees enough to make a case especially if most could not properly identify the suspect?

A: Eye witnesses who are not co-defendants usually are well regarded by juries. So yes, the word of eyewitness could help make a case that is otherwise weak much stronger.
