Legal Question in Criminal Law in New York

I bought a car on Saturday and the salesmen said it would be ready monday. Well come monday it was not ready he said he couldn't get it inspected that day and it would be ready the next day so the next day he says it needs breaks and some other stuff to pass and it wouldn't be done till the next day. So I was like ok something is not right And so i had my friend call and ask what. Cars he had for sale and he told her the car he sold to me was still for sale and she could come look at it.so he keeps saying it needs to get Inspected but told her it was inspected already. Some girl called me and said that she signed to finance the car two weeks ago and he kept putting her off to. So the. I was pissed and called my husband and he called the dealer and the dealer said the girl was crazy and got my number off his desk and he had to keep her out of her store. And that the car was still mine. So basically he is scaling people and lying. He has my downpayment and I feel what he is doing is illegal what should I do. I've taken off work to get the car and missed school cuz I have no car and I've been paying insurance on it for for five days!!!,
