Legal Question in Criminal Law in New York
Hallo,my brothe has been in jail for 3 months,charges are:sexual assault, assault and battery the lady was 80 year old by then.He used to work in a Nursing Home 12 years ago when this happened.12 years ago the woman had a virginal tearing and she had some blood in her diaper,the police were called and they confirmed it was Sex assault.He was arrested in june 2010.They said it was because he was the only Male who was working in that shift that day.In August,the DA took the DNA from my Brother and the Pre-trial was yesterday,the Judge ordered the DA to have the DNA TESTED ASAP.The DA suggested to us to bring our DNA EXPERT the next court date.I dont understand because in the first place they wanted to do themselves,I dont understand why they are asking for our DNA Expert.The stuff they have to text are THE DIAPER she had 12 YEARS AGO.The woman died in 2007.Please HELP AM CONFUSED
