illegal videotaping
is it illegal to videotape yourself having sex in your own home without the other persons knowledge and if so what is the penalty and statute of limitations in the state of new york.

NO, the use of a video camera in ones own home is not illegal, even if you are taping sex acts.
If you post the tape, display it, use it, or otherwise make it available to others you are opening yourself up for a lawsuit. You have the individual right to do what you wish with it, but you also need the permission of the other person(s) to display, share, publish, etc the tape.
