How long could a inmate stay in jail before they see a judge? The lawyer filed a motion in Sept. and my husband haven't seen a judge as of yet.

Your husband's case is probably appearing on the court's calendar every 4 to 6 weeks. The attorney is probably waiving your husband's right to be present.
Write a letter immediately to the lawyer stating that you revoke any waivers of your personal appearance in court and also demand an immediate conference with the lawyer.
