Legal Question in Criminal Law in New York

Sex Tape

A dear college friend of mine recentely made a sex tape with he and his ex. She wants him 2 give her the tape and is telling him if he doesn she will file a case against him. He has not shown me or anyone the tape to the best of my knowlege. Both he and the female agreed to the making of the tape. Could she file any type of case against him?

Re: Sex Tape

Having authorization to make the tape, does not provide authorization to distribute it.

Your friend should consider carefully his action if he decides to share it with the world.

Re: Sex Tape

In the real world no. Theoretically, if she can prove he distributed it, she may be able to bring an action. But if he claims someone stole the tape from his room, "wink" "wink", and he doesn't know how it got on the internet, how does she prove anything? Basically, she was dumb, and now she has this hanging over her.
