Legal Question in Discrimination Law in New York

position elimination

my position was eliminated but someone else was given my duties and responsibilities. When I called the company to ask for the person in the position i was taken from, that person answered the phone and confirmed that the position eliminated weas actually given to him. is this leagl?

It is legal to be replaced as long as you are not a member of a protected class and the reason for your job loss is a pretext for unlawful discrimination.
