Legal Question in Elder Law in New York

Family Contributions

My two brothers live with my father. My father suffers from a denerative memory disorder. Brothers ages are 46 and 40. The 40 year old contributes nothing to the home financially or in the care of my father. What are my rights as the daughter. I do have power of attorney for my father and would like the 40 year old to move out. What are our options. He has a good paying job, yet he offers no assistance.

This is a complex situation that really requires an in depth consultation, and depends on the extent of your authority as attorney in fact.

You should voice your concerns to your brothers;

whether you can force him to contribute is another matter.

Your Power of Attorney doesn't give you authority to kick your brother out. I don't see where you have any recourse. What is your older brother doing about the situation?
