Legal Question in Entertainment Law in New York

Hi,

(I'm not sure if this is business or entertainment law)

In a promotional venture, I decided to stand on the street outside famous music clubs and give away free CDs of my music to people standing in line to see the show at the club.

Is this legal?

There is a couple of levels to your question:

(i) you can give away your CD to people;

(ii) BUT FIRST copyright the music at the Copyright Office of the Library of Congress; and

(iii) you can be limited where you do it by the rights of the owners of the land, in this case the clubowner.

I disagree with Mr. Nebgen's response. If you are on a public street you have the right to give away your CD to people - without interference from the clubowner.
