can i get accused of abandonment if i move out of my house with my son and leave my boyfriend??

I assume you mean abandonment as grounds for divorce. The answer is No. You are not married.

No, but you didn't say if the boyfriend is your son's Father.

If he is and you are obviously not getting along, move out and file for custody.
