Legal Question in Family Law in New York

Hi me and my boyfriend are parents to a new born. My son is born in California. My boyfriend wants to move to New York were he has family. I want to know if My boyfriend and I break up can he obligate me to stay in that state until the child turns 18. Even though the child is born in California?

It is irrelevant where your son was born. A New York court cannot force you to stay in the state. However, it does have the authority to change custody if your boyfriend forces the issue. Therefore, in essence if you want to keep custody of your son, it can force you stay in New York. Therefore, if you don't have long term prospects with him (aka marriage), you may want to rethink moving to New York.
