Child Custody
Can you file for custody if you live in the same house. Husband is filing for divorce. Can the wife go get custody first without moving out of the family home.

Some one will have to be the custodial parent. You can file a motion to make yourself the custodial parent in the divorce case.
You can remain in the home.

AS part of the divorce, one of the parties will have to be the custodial parent, unless there is some type of joint custodial parenting arrangement.
