Child Custody

I recently moved to Georgia from NYC (Feb 2007). My son has always lived with me. His father and I came to an agreement that my son will stay with him until June 2007, so he can finish the school year, then come to live with me in Georgia. He is now chaning his mind and won't allow me to communicate with my 6 year old. What can I do?

If your decree was issued in NY, it will control. Consult with a local attorney. It may be necessary to associate a NY attorney to help with that aspect of your situation.

Was the agreement between the two of you reduced to writing? If so, then that should govern if he refuses to return the child. Either way you will have to go to court and file a petition, if he refuses to return the child. Since you have only been in GA for a few months and the child is here, I suggest you hire a New York attorney to file on your behalf. You may contact my office.
