Legal Question in Family Law in New York

Child Support and adoption

When I was 19 I was drugged and raped. I never had any idea who raped me as I was at a party where I didn't know anyone (one of those signs on a college lamppost parties) I was handed a drink, drank it, and woke up in the morning with the impression that something was vaguely wrong. 3 months later I discovered I was pregnant. I had the child and planned on giving him up for adoption, however, the hospital and my family pressured me to keep him, which I was not prepared to do. My mother convinced me to let her raise him and he has been raised by her, as my brother, but has always been aware that he grew in my body. Now, my mother has fallen on hard times. She applied for food stamps and Medicaid and was told she could ONLY receive cash benefits. Now they have began to pursue child support proceedings against me and the father. B/C I have absolutely no way of knowing who that is (male who went to an SU party in May of 1992??) they are now pursuing support from me. I provide as much assistance as I am able but have my own daughter to provide for. I rent my house to my mom at less than my mortgage and pay my own rent. I feel like I'm being raped all over again and want to know what I can do. Can adoption proceeding be started? Help!

Re: Child Support and adoption

Adoption procedings at this point would not be possible since the court or at least social services will not allow you off the hook for your child. You should contact an attorney in your area to consult on this matter.

Contact the local bar association for a referal to an experianced family law attorney.

You should try negotiating a settlement of your support obligation. Having a good attorney who can present a strong defense for you will help. You can call my office to schedule a consultation, if you're interested.
