Legal Question in Family Law in New York

Child Support

My children and I live in NY and their fathers resides in VA. He has never lived in NY nor has he ever worked in NY, does that mean that I cannot file a valid petition for child support in NY? Or do I need to file in the state where the children were born and the father resides? Please advise. Also, do I have to use a lawyer in order to have a subpoena issued for the Paternity letter on file with DOHMH in VA?

If the you live with your children in NY, You may file a Child Support Petition in a NY Family Court, (which Court can "correspond" with the VA Court, having juridiction over your child's father).
