Legal Question in Family Law in New York

child support modification based on disability income(non-taxable)

I started receiving the non-taxable disability income payments 1 year ago. My monthly income is the same as before when I was employed but I'm totally disable right now and do not have any other earnings. Do I have to pay child support of this kind of income?

Re: child support modification based on disability income(non-taxable)

It depends on the kind of payments you are getting. If you are getting social security or insurance disability payments those may be attached. SSI (a program of US Social Security) is not attachable income.

IF you are a disabled parent, your kids may be eligable for SSI and other funds that may offset your child support responsibility.

Good luck.
