Legal Question in Family Law in New York

If I go to court to get physical custody of my son who has been living with me for the past four years can his mother be allowed to maintain physical custody and have him come live with her in order to continue receiving support. I have paid her supprt while he's been living with me but enough is enough. He is do to leave for college in September.

You should have resolved this years ago.

She can attempt to maintain formal custody of him, but he's been living with you for fours years, and he is old enough to voice his desire to live with you.
