Legal Question in Family Law in New York

divorce

I have been married for 34 years, separated 6. Before my father died I inherited his home, he changed the deed to my name. Now my husband wants half the house, is he intitled to half this home?

Re: divorce

It sounds like you need to speak to an attorney. If the house was inherited then it is more than likely separate property. However, there are actions undertaken by the non-titled spouse that could change that, making the once separate property to equitable distribution. www.traceyabloodsaw.com

Re: divorce

Generally he would not be entitiled to the house but would be entitled to an offset on the equitable distribution split if you spent marital funds to pay for improvements to the house, paid back taxes (or present ones) or the like.

Seems like you would best protect the asset by hiring a good lawyer to protect you.

Good luck.
