Legal Question in Family Law in New York
Currently I am a female that has filed for divorce from my husband. We have a home that would be considered marital assets. My name is the only name on the home. The balance of the mortgage and the home equity also....there is no asset if the home was to be sold we would probably owe on it. If I wanted the home and no equity would be available for my husband, would I be the best ad first person who could the house?

The question was not clear. However, you can negotiate to remain the house. If there isn't equity and you're the only one on the mortgage and the deed, it is unlikely your husband will want to remain in the house. However, he may use your desire to remain in the house to negotiate other concessions from you.
