Legal Question in Family Law in New York

Good morning. I am helping my Mother with her divorce. She lives in New York State. My parents were divorced several years ago and we are having trouble collecting what my Father owes her. He owns a business and his new wife owns a business as well. Is there any way we can garnish the profits of both businesses to start collecting what my Mother is owed?

You may have missed a step. I assume your father owes your mother under a divorce decree. Therefore, she should file a petition for contempt. If the court holds him in contempt, he will have to pay. If he still refuses, the court can give him a variety of sanctions.

Your mother can also sue him in civil court. Thereafter, she can place a lien on his business and bank accounts.
