Legal Question in Family Law in New York

If my husband and I are not under CPS investigation (my step daughter;s mother is) does CPS have athoritiy to do a home search on us? And also they want to ask my 11 yr old daughter questions about what she has seen down at her mothers. It has absolutely nothing to do with my husband and myself. Do we have to let them come in and do a home search?
