Legal Question in Family Law in New York

My husband and I are separated but not legally. He moved into his own apt. We saw a mediator for a period of time, then he said there was not enough money to continue seeing the mediator and he wanted to take a break from the process (not to get back together, I assure you,all for money reasons). He agreed has agreed to sign the house over to me and I can now attempt to refinance in my own name and take over the mortgage. My 7 year old twins live with me. My husband gives me money every paycheck and tries to give me more when he has it, not legally because we are not legally separated because we do not have the extra money for a divorce or legal fees. I realize he can stop theses payments to me at anytime and then I will be forced to get an attorney. Do I move forward with refinancing the home and having him sign the deed over to me? Will I need to have a lawyer involved in the process?

It's possible, though not entirely likely, that you'll be able to get through the closing of your acquisition of the house on your own.
