Legal Question in Family Law in New York

I live in NYC... And lately I've been having problems with my child's father and his family. He has a court order of visitation however both him and his family have become increasingly disrespectful & aggressive towards me. I want to to know if I can have my daughters last name changed to mine. Her ather has a court order of visitation but his name does not appear on the birth certificate. Can I go about the name change without his consent.

Also I have a police report against him and his mother for NOT wanting to bring my daughter back to me and I also have aggressive text messages from his mother .... Is there a way I can go about making a change in his visitation to EXCLUDE his mother.
