Legal Question in Family Law in New York

I live in NYS. My husbands son's mother is requesting an increase in her child support payments. Will my salary be considered when they are evaluating his new payments? We filed taxes joint last year and they are requesting our tax returns from last year.

Although you filed joint tax returns, the court can use your husband's W-2 or 1099 to determine his income. No, you are not liable for his child support payments. If your husband wants some idea about his child support obligation, he should go the NYC Child Support Calculator

http://www.nyc.gov/html/hra/html/directory/child_support_calculator.shtml

He should also consider returning to the attorney who handled the original child support matter to handle this modification case.
