Legal Question in Family Law in New York

M y childrens mother signed over her parental rights a few years ago. The maternal grandmother and i have custody of the children. The mother now states that she wants to take the children and move to Virginia. The maternal grandmother and myself do not want to allow this to happen. We all currently live in Brooklyn, NY. What are our options from preventing this to happen. If the mother of the children takes us to court can she get her maternal rights back.

Did you go through the courts to extinguish her rights? If so, it will be difficult to her to regain those rights. Assuming she is successfully in obtaining her parental rights, the court is not likely to give her custody of the children. At a minimum, she will probably be given supervised visitation within the state. At the maximum, she will be given liberal visitation on major holidays.

In any event, you need an attorney to protect your rights in court.
