Legal Question in Family Law in New York
I was married almost 10 years ago. I havent seen my husband in about 6 years and have been asking for a divorce for the last several years. He always gives me the run around, and refuses to give me his whereabouts so that i can serve him papers. I just finished paying a $2000 tax debt owed by him. I am unemployed and cant afford a PI to track him down, so I need to know what exactly a judge will need to satisfy the requirements to serve him by publication. Will the fact that he is aware of my intentions and refuses to be served work in my favor or against me?

You should search for pro bono (free) lawyers in your county. You can start with your county's bar association. If your income qualifies for the local pro bono program, you should retain the attorney. If you qualify, the attorney can use his/her resources to try to find your husband.

If you are receiving public assistance, you may qualify for a waiver of court fees and publication costs. Contact a NY divorce attorney for details. Any divorce lawyer with good skills should be able to help you with this. The cost should not be too high.
