Legal Question in Family Law in New York

NYS child support income over $80k

Is it likely that a judge will deviate from the CS guidelines if combined income is over $80k? NCP makes $140k and CP makes $25k... and NCP does pay extraoridinary visitation expenses and has the child for over a month in the summer. Is that cause for deviation from the normal 17% of NCP's income?

Re: NYS child support income over $80k

Most courts deviate from the CSSA on income above the combined $80,000. They will apply the 17% (for one child) for the income up to the $80,000 then they can apply any amount to the difference, in your case the other $65,000 of combined income. They will consider several factors when making that determination.
