Legal Question in Family Law in New York
Personal belongings after divorce
My ex husband and I have been divorced for a little over 4 years now. He didn't take several things that he could have according to the Decree. I have asked him several times 2 years ago to take his stuff, and he said he doesn't need it. Nothing was done in writing, but now, 4 years later he is asking me for couple of the items, which I have gotten rid of. Can he sue me?

Re: Personal belongings after divorce
He can, in fact, sue you, but whether he will win or not is another issue. There is a responsibility of someone who holds property to take care of it. however if when you called him you told him you would sell or trash the things if not picked up then you may have a decent defense.
It is unlikely there will be a law suit unless these items were valuable.
