Legal Question in Family Law in New York
I have a question regarding temporary custody. I live in new york with joint custody and placement of my 1.5 year old son. I have recently been granted the pleasure of going to college in p.a. for a year and with full support of my family. My grandparnets have offered to take my role while i am gone at school as long as they have some type of temporary custody. Now the mother to my son does not agree to this because she believes she should have the child the whole year that im gone and things would return to normal when i return. I do not agree to that as the mother is 20 years old with no car, no job, lives with her mother which is a discusting place. I guess i would like to know if this is something i should take to court and fight with her about to get my way to provide the best home for my son while i am gone.

Before going to school, you should resolve this issue.
You can transfer legal guardianship to your grandparents through a court order.
Otherwise, the mother will terrorize your grandparents and possibly sue in court. You don't want to leave school to handle this matter. So, get it out of the way beforehand.
