Legal Question in Family Law in New York
Seperation requirements
My wife and I have been living apart for two years. She is seriously involved with someone whom she began seeing while we were still together...the main reason for our split.
We have no legal seperation agreement although we have had an informal financial arrangement to date. We our on friendly terms and our kids are grown and on their own.
My question is: Can I get divorced w/o any further financial considerations to my spouse?

Re: Seperation requirements
You can get a divorce based on the fact that you wife comitted adultery.
Since you will be the party filling for the divorce your spouse will have to request alimony in her response to your petition for a divorce.
