Legal Question in Family Law in New York

I have a signed legal agreement stating I am able to speak to my children on the phone each night between 6-10pm. Everytime I call my ex either doesn't answer the phone or tells me the kids are out or not available and he has the only phone. Do I have any legal recourse and if so what?

Yes, file a contempt action. You can seek relief by requesting make-up time by phone or in person. If this contempt continues after you win this first contempt petition, the judge has several options, including changing visitation or custody.
