Legal Question in Family Law in New York

I had my son Feb 14, 2012 and recently yesterday found out that my boyfriend the father cheated on me with another girl from his work...Ive lived in NY since April 5, 2011 and im not from NY and have no friends or family up here...So if i want to leave with my son to go to florida where im from is that ok?? we havent been to court theres no custody established...i will not live with him and i have no where else to go...so can i take my son to FL??

If he has not established his rights as the legal father (and has not filed anything to start the process), you are the only one with any rights and you can move from New York. However, New York will still have jurisdiction to hear any of his petitions within six months of your move. This does not necessarily mean you will have to move back to New York.
