Legal Question in Family Law in New York

My wife and I are from NY. She is still there with our two children. I'm in Florida. We are not legally sperated. Do I have to go to NY to file for divorce?

You would have to look at Florida law. I would suggest re-submitting the question to a Florida lawyer.

If you want to file in Florida, you will have to look to Florida Law for the answer on residency, custody and distribution of assets. If all of the assets are in New York as well as the children which will most likely entail a custody agreement or fight, you might want to bring the action in New York. You do not have to be present for all actions and most can be handled by telephone, e-mail and regular mail. You will need representation for that action. I would go and consult with an attorney in Florida and then call and talk to several attorney's in New York before you make your decision.
