Legal Question in Medical Leave in New York

short term disability

i am having surgery and will need to be out of work for about 6 weeks of which time I will be on short term disability. Can i be fired for taking this leave?

Assuming you meet the legal definition of an 'eligible employee' and you work for a 'covered employer', you should specifically request to take Family Medical Leave in order to safeguard your job. You can research the legal definitions at http://www.dol.gov/esa/whd/fmla/
