Legal Question in Medical Leave in New York

Fmla and pregnancy

If my wife goes out on fmla and the company goes bankrupt or is taken over by another company what can happen legally to her job. Also would the short term disability and or medical benefits be affected by this.

Your question poses multiple possibilities. If the company truly goes belly up, everyone is laid off and the company is dissolved. If the company is bought out by another company, your wife should be able to maintain her leave, but it depends on the size of the company taking over and any downsizing that takes place.

If you believe your wife is in danger of being terminated or having her FMLA rights threatened, you may contact my office through SeveranceAttorney.com or via email.
