Legal Question in Civil Litigation in New York

Ice and snow

Snow and ice fell from my neighbor's roof and caused major damage to my car. The neighbor's home owner's insurance denied the claim. Who is liable? Our insurance won't cover this either.

Re: Ice and snow

Ultimately, it is your neighbor who is responsible for damages to your property. It is not out of the ordinary for home owners insurance to deny such a claim. You may file a law suit against your neighbor if he/she refuses to pay for your damages. Once a suit is filed, his/her insurance is likely to defend the suit or settle with you. Good luck.
