Legal Question in Civil Litigation in New York
If a person in a civil action, yet without funds for a lawyer. Can that person defend in a pro se position. And can a person petition the civil court judge for the appointment of counsel for a defense?

It all depends on what type of civil action. In most civil matters, a person is not entitled to an appointed lawyer. However, there are attorneys who take matters pro bono matters. You should check with the bar association in your county.
