Legal Question in Civil Litigation in New York

Getting a pet back

What are my chances and what should I do about getting a dog back that I gave to friends to adopt, but now I suspect he is being abused. I adore the dog, but I wasn't able to give him all the attention he needs at the time and I thought they could, but they are not and the father has a bad temper and obvious anger issues. Actually I fear that his 2 children are at risk too. I know they are mentally and emotionally, but physically I am not sure. I would be willing to bet that he is taking his anger out on the dog instead. I want him out of there. I want him back. There are no legal papers of any kind. They just took him in and now thats where he resides. Unfortunately, he is an Albany city cop and I would imagine he would try to use that to make this difficult. What can I do?

Ask the SPCA to check on the welfare of the dog.

Re: Getting a pet back

You may have a claim for breach of promise (in small claims court) for failure of your fiends to care for your former pet. To prove such a claim you must have evidence of mistreatment and not just speculate, guess, or any other clairvoyant suggestions or suspections.
