Legal Question in Civil Litigation in New York
Request for Judicial Intervention
I'm aware that the attorney for either party may file a Request for Judicial Intervention; however is it the court clerk's responsibility to accept the RJI from the attorneys of record? There has been an improper substitution of attorneys in this case and the ''new'' attorney filed the RJI. How can this be resolved? I'm a pro se and filed a motion for summary judgment and was told the RJI had already been filed. I thought that the retiring attorney had filed the RJI; but apparently it was filed by the new attorney.

Re: Request for Judicial Intervention
The clerk will check to see the parties...and they did not match...but..if you filed a motion..either you or the other side filed an RJI--no RJI...no motion.
Good Luck
