Legal Question in Immigration Law in New York

i am US citizen married to an illegal alien who entered the US when they were 5 yrs old. what can i do to prevent them from being sent back to their country?

If he is eligible for Cancellation of Removal, it could be an option.

If you petition for him as your husband, he will be required to go back to his country and apply for a visa and a hardship waiver, unless he is protected under 245i.

I suggest that you consult an immigration attorney (not a notario or specialist). Especially, if he is already in removal proceedings in Immigration Court.

Depends on the circumstances of your spouse's entry. Your spouse may eligible for cancellation of Removal, and may be even to adjust the status and get a green card based on a marriage to a U.S. Citizen.

You should consult immigration attorney to fully evaluate your case and advise you properly, as more information is needed to know exactly your spouse's status.
