Legal Question in Immigration Law in New York
I have a company and I want to bring someone from India here on an h 1 visa. starting work in October is the lottery up for 2009 yet? Also I need a lawyer to make my company legal so I can take people on H 1 this will be my first. but first I want to know if the 2009 lottery has been filled yet?

There has been no lottery this year. The quota for H1B for FY 2010 is still open, as per the most recent updates from USCIS.
I would need more information regarding your particular case before I can comment on it properly.
However, I can say from reading your e-mail that clearly you do not understand the lottery system.
At the beginning of each lottery period for H1-visas the visas are normally allotted within days for there are always more companies applying for those visas than the number of visas available.
Accordingly, for this period 2009-2010 the visas have already been allotted because those companies put their paper work in months ago of time and then file immediately thereafter.
