Legal Question in Immigration Law in New York
I am want a divorce from husband who does not have his papers or started the process. We don't have any children or assets together but I want a divorce on the grounds of fraud. If I file for divorce under fraud will that interfere with him getting his papers later on after the divorce is final. Will he get in trouble with immigration if I do file under fraud.
1 Answer from Attorneys
Assuming that you are a US citizen, he will not get a green card after divorce if you haven't even filed anything/didn't petition for him, and he didn't get a green card. Divorce proceedings are not connected with immigration services.
