Legal Question in Immigration Law in New York

A friend of mine is holding H-4 visa and now staying in New York. She would like to get a re-entry visa for visiting back her mother country. Are there any means that hinder her from applying re-entry permit? How can she apply for it, and what are the procedures to undergo with?

If she is in a valid H4 status and has an H4 visa, she doesn't need any re-entry permit. If a visa had expired, but H-1B visa holder is still in a valid status (and she is in a valid H4), she can apply to renew a visa (H4) while abroad in her home country.

It's not a reentry permit, but a visa.

I would need additional information regarding your particular case before I could comment on it properly.

However, your friend will have to contact ICE (the immigration service) and explain the situation regarding a visit to see her mother.

The immigration service is fully aware that while visa holders are here they may return to their country of origin to visit family members.

Do you mean reentry permit or a H-4 visa stamp to enter back into the country?

Reentry permits are generally issued to green card holders (legal permanent residents) staying outside the United Sates for more than one year.
