Legal Question in Immigration Law in New York

good day I need some advice my son came to america on a visitor visas 8 years ago he went back to Trinidad last year on emergency death I want him to come back to America can he apply for a visitor visas will he get it and also he was on a one year probation in 2006 a small amount of weed he is 23 years old I just want him to come back .all my taxes are up dated and my papers are in the NATIONAL BENEFIT CENTER WAITING FOR APPROVAL. thanks .

Your son will not be able to come back on a visitor's visa. When he left the USA after being here illegally for over a year, he became inadmissible for 10 years (from the date of departure).

If you mean that you are a US citizen and petitioned for your son's immigrant visa, whenever the priority date is current, he will have an option to apply for a visa in Trinidad. However, he will need a waiver of the 10-year bar. Also, a drug conviction can make him inadmissible. Depending on a type of drug offense, he may or may not be eligible to apply for a waiver. Unfortunately, it doesn't seem likely that he will be able to come back.
