Legal Question in Immigration Law in New York

Hello,

My name is Sana. I have two children and I need a babysitter. I have a friend, who is a citizen of Holland but living in London. I want to bring her to NY, USA to babysit my kids. She also wants to stay here and get a greencard. I will support her and she will work for me. I work in a bank and so does my husband. We pay taxes and can prove our income to support my babysitter. Now my question is that, is it possible to bring her here? If it is, How? Thank You so Much.

I don't think that it's possible to get her a visa as a babysitter "invited" by yourself. There are special Au pair programs for that.

If your friend wants to come in this country legally she will need to come in as an Au Pair or a domestic employee. Both of these positions will require her to apply for a visa from her local US Consulate in order to enter US.

If her application is approved she will be granted a J1 or B1 visa and you will have to provide your tax information for the past three years to show that you can support her.

Please note that immigration will investigate you and your husband�s immigration status.

Please also note that the J1 or B1 visa will not give your friend an automatic right to get a green card.
