Legal Question in Immigration Law in New York

Hypothetically speaking, can a person who legally entered the US on a visa wavier, overstayed over the 90 days(2 yrs to be exact), then gets a job on a cruise ship that happens to go to that person's country, Can that person legally come back to the states through another port?

No, when he left the USA, he became inadmissible for 10 years.
