Legal Question in Immigration Law in New York
I came to the us illegally. According to my mother my dad and her had work permits given to them by political asylum. She told me that back in 1998 she applied for me to be a resident and I received a letter with my social security number and a court date. Since my parents seperated and went through a lot of trouble including being in jail, I never went to the court date. We never followed up with anything about my case and now she told me that in 2004 she received a letter of deportation for me. I was wondering if now there is anyway to fix my status.

If you were ordered deported but never left the country, it means that you are in the country illegally and subject to deportation/removal if apprehended by police or ICE.

IF YOU WERE A MINOR, THE MAGIC AGE IS 15 YEARS OLD. IF YOU MISSED YOUR DEPORTATION/ REMOVAL HEARING AS A MINOR, THERE IS A SEPARATE SET OF RULES THAT BENEFITS YOU BECAUSE OF YOUR AGE AT THE TIME. WE HAVE BEEN SUCCESSFUL IN SEVERAL CASES SUCH AS YOURS WHEN WE ARGUED THAT IT WAS NOT THE MINORS FAULT BECAUSE OF HIS OR HER AGE. WE HAVE SUCCESSFULLY WON SEVERAL CASES SUCH AS YOURS BY FILING MOTIONS TO REOPEN. OF COURSE, IT DEPENDS ON THE JUDGE AND THE WORK MUST BE PAINSTAKINGLY PREPARED AND THE ARGUMENTS CAREFULLY DRAFTED.
