Legal Question in Immigration Law in New York

My spouse received a letter for I guess what is the AOS interview. But we haven't been together for some time and I had a child with someone else and currently live with my son's father. What is the best thing for me to do-should I go with him or not?

The purpose of the adjustment of status interview is to determine whether you live together as a married couple, whether it's a real marriage or a sham marriage, etc.

If you are no longer together, it means that if you go, you will have to lie about your relationship, or you can choose not to attend the interview.

Misrepresenting or lying about a "sham marriage" is a serious federal crime, punishable by fine up to $250,000 and/or 5 years in prison.

If you choose not to attend the interview or write a letter to USCIS informing them that you are separated, etc, your foreign spouse's application is likely going to be denied, and they will be referred for removal (deportation) from the USA.
