Hi, i have won the US diversity visa for 2010, my number was bit late. was called for embassy interview outside USA (US embassy) in mid august 2010, paid the fees for document examination and supplied all the required documents, had no visa issued up to the end of the program on 30 september. as far as am concerned no decision has been made to deny me the visa, it was just about the program time ran out while my case at (administrative processing), can i appeal? should i get my fees back?

No attorney can help you in the situation where a DV visa wasn't issued prior to expiration of the DV period, September 30, 2010.
All visa fees are non-refundable. There is no appeal and no reconsideration. This is the lottery. It had ended and you didn't get a visa. You should have tried to contact the Consulate and ask to expedite, if possible, prior to Sep 30th. You may try again the next year (filing period starts today). However, prior to that you should consult a lawyer and see if there are some inadmissibility issues in your situation.
