Legal Question in Immigration Law in New York
I work for a consultancy who is my employer. My end-client has a preferred vendor who has a contract with my consultancy. So, it is consultancy -> vendor -> end-client.
History:
H1B extension was filed in June (premium processing).
RFE was sent at the beginning of August.
RFE was responded to by mid-August.
Denial was received at the end of August. ("Employer-employee relationship")
Left the country mid-September.
MTR was filed last week of September by the consultancy's attorney.
How long does it take to get a decision for the MTR? What are the chances of getting the H1B extension?
1 Answer from Attorneys
Chances are not very good. However, you shall consult your attorney for a specific advice.
You might be better off looking for a new employer who can file a new H1B petition where you are directly employed by a petitioning employer.
